Terms of Service

Opportunitree is designed for high school students, school counselors, and school administrators. Use of the platform is subject to the following conditions:

• Students under 13 may only use the platform with verifiable parental or guardian consent, or through a school that has agreed to obtain such consent on their behalf under COPPA.
• Students 13 and older may create accounts independently, subject to these Terms and applicable school policy.
• Counselors and administrators must be affiliated with a school or district that has entered into a Data Privacy Agreement with Opportunitree.

Opportunitree is an educational tool. Your access to the platform is granted solely for legitimate educational purposes, including discovering extracurricular programs, tracking college-prep milestones, and receiving counselor support.

You agree not to use the platform to:

• Engage in any illegal, harmful, or misleading activity
• Harass, bully, or harm other users
• Attempt to access accounts, data, or systems you are not authorized to access
• Reverse-engineer, scrape, or reproduce any part of the platform
• Upload or transmit malware, viruses, or malicious code
• Circumvent any security, rate-limiting, or authentication measures
• Use the platform for any commercial purpose not authorized by Opportunitree

You are responsible for maintaining the security of your account credentials. You agree to:

• Keep your password confidential and not share it with others
• Notify us immediately if you suspect unauthorized access to your account
• Provide accurate and complete information when creating or updating your profile
• Not create multiple accounts or impersonate another person or school

We are not liable for any loss or damage resulting from your failure to protect your account credentials.

Schools and districts that deploy Opportunitree agree to the following additional obligations:

• Ensure that student data shared with Opportunitree is limited to what is necessary for the educational service
• Obtain any required parental or student consent before enrolling students in the platform, including COPPA consent for students under 13
• Notify Opportunitree promptly if a student should be removed from the platform (e.g., withdrawal or graduation)
• Use counselor tools (dashboards, student data access, milestone assignment) only for legitimate educational purposes
• Ensure counselors and administrators comply with these Terms and all applicable privacy laws

Opportunitree surfaces opportunities, programs, scholarships, and competitions sourced from third parties. While we make reasonable efforts to verify deadlines and program details using AI-assisted research, we cannot guarantee the accuracy, completeness, or availability of third-party information.

You are responsible for independently verifying all program details — including deadlines, eligibility requirements, costs, and application processes — directly with the program provider before applying. Opportunitree is not responsible for missed deadlines, ineligibility, application fees, or any other outcome related to a third-party program.

The Opportunitree name, logo, platform design, content, software, and all related materials are the exclusive property of Opportunitree and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, reproduce, or distribute any part of the platform without written permission
• Use the Opportunitree brand, logo, or name in any marketing or promotional material
• Create derivative works based on our platform or content

Content you provide to the platform (survey responses, milestone notes, etc.) remains yours. You grant Opportunitree a limited license to use that content to provide the service to you.

We reserve the right to suspend or terminate any account that violates these Terms, at our sole discretion, with or without prior notice. Grounds for termination include but are not limited to:

• Providing false information during signup
• Unauthorized access attempts or security violations
• Harassment or abuse of other users or platform staff
• Violation of any applicable law

Schools and districts may terminate their contract with Opportunitree at any time with 60 days written notice. Upon termination, we will delete all school student data within 90 days per our SOPIPA obligations.

Opportunitree offers an optional paid Premium subscription that unlocks additional features. A free tier remains available at no cost. By purchasing Premium, you agree to the following:

• Eligibility to purchase. You must be at least 18 years old to purchase a subscription. If you are under 18, a parent or legal guardian must complete the purchase and agrees to these billing terms on your behalf.
• Recurring billing. Premium is billed in advance on a monthly or annual basis, in U.S. dollars, through our payment processor, Stripe. Your subscription automatically renews at the then-current price at the end of each billing period until you cancel. By subscribing, you authorize us and Stripe to charge your payment method for each renewal.
• Cancellation. You may cancel at any time from Settings → Manage subscription (also on your Profile page), which opens the secure Stripe customer portal. Cancellation stops all future charges; your Premium access then continues until the end of the period you have already paid for, after which the account reverts to the free tier. The free tier requires no cancellation.
• Refunds. Except where required by applicable law, all payments are final and non-refundable, and we do not provide refunds or credits for partial billing periods, unused time, or features you chose not to use. If you believe you were charged in error, contact us at support@opportunitree.us and we will review it in good faith.
• Price changes. We may change subscription prices or the features included in a plan. We will give reasonable advance notice of any price increase, which will take effect on your next billing period. Continuing your subscription after a change takes effect constitutes acceptance of the new price.
• Failed payments. If a renewal payment fails, we may suspend or downgrade your Premium access until payment is successfully processed.
• Payment processing. Payments are handled by Stripe under its own terms and privacy policy. We do not receive or store your full card details.
• Taxes. Prices shown may not include applicable taxes, which will be added where required.

Nothing in this section limits any non-waivable rights you may have under the consumer-protection or auto-renewal laws of your jurisdiction.

To the fullest extent permitted by law, Opportunitree is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to missed opportunities, application outcomes, or reliance on third-party information.

Our total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the amount paid by you or your school to Opportunitree in the 12 months preceding the claim.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Hillsborough County, Florida.

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and notify users by email or in-app notice where required. Continued use of the platform after updated Terms are posted constitutes your acceptance of the changes.
